tom and katie smilingTomKat is officially over. Tom Cruise and Katie Holmes divorce case is finally done. Court records that were filed in New York City state that the case was closed on Monday. This has been one of the most calm divorce cases that we have seen in a while. The couple said in July that an agreement had been reached only two weeks into their divorce case. Lawyers and representatives have refused to disclose any of the details of the case.

The 33 year old actress completely blindsided her husband of five years and most of America by filing for divorce on June 28th. As part of their speedy settlement, Holmes has received primary legal and physical custody of the couple’s daughter, Suri, who is six years old now.

Cruise and Holmes were married in 2006 in a very elaborate ceremony in Italy. Though it was Holmes’ first marriage, it was the third marriage for the 50 year old actor, who had previously been married to Mimi Rogers and Nicole Kidman.

There has been tons of rumored information regarding the couple’s divorce, but here is what we know. The couple had only been married for a little over five years. There were no previous indication that the couple was having any troubles. It seemed as if Holmes’ was hiding out while her husband was out and about, promoting his latest film, “Rock of Ages.” Holmes’ attorney said in a public statement that her primary concern is and always has been Suri. Cruise’s publicist told E! News that he was very deeply saddened.

There were numerous rumors surrounding the couple’s daughter and the custody battle. Some tabloids were stating that Holmes’ was seeking katie smilingsole custody of their daughter. Some said that it was significant that Holmes’ had filed in New York City, stating that the city is more than likely where Holmes wants to live with Suri.

Holmes’ had haired the New Jersey divorce lawyer, Jonathan Wolfe and New York attorney Allan E Mayefsky to represent the actress. The couple did have a prenup. The contract reportedly called for Holmes’ to receive a payout  with amounts depending on how long the couple had been married. The prenup also supposedly discussed child custody.

Of course the rumor mill was working overtime when it came to the Cruise’s religion. Holmes’ was reportedly very uncomfortable with her husband’s commitment to Scientology and how it all would affect Suri. Holmes had previously put up with it all, but had recently begun to see it all in a new light and began to pull away.

At least publicly, it seems like the couple is both sticking to their words regarding their daughter. Both parents seem intent on making sure that Suri is their number one priority. They released a statement shortly after the couple reached a settlement stating “We are committed to working together as parents to accomplish what is in our daughter Suri’s best interests,” and it seems that they have done just that.
