halle smiling at premiereHalle Berry is in court today trying to convince a judge that it is in the best interest of her daughter Nahla, who is 4 years old, for the two to move to Paris. Gabriel Aubry, Nahla’s father, is vigorously opposing the move. But Berry has some tricks up her sleeves. Berry will be trying to prove today that it is unsafe for her and her daughter to continue to live in the US because of none other than the paparazzi. Berry claims the paparazzi have created an extremely dangerous environment for her daughter to grow up in.

According to various paparazzi agencies, Berry’s lawyer, Stephen Kolodny, is searching for proof. He’s hoping he can find video of Halle and Nahla being “Terrorized” by overly aggressive photographers to show the judge. The trial will include a video presentation of an instance when Berry had to call the Beverly Hills Police depart to come help her and Nahla escape from a surrounded restaurant.

Berry’s attorney has subpoenaed none other than Andrew Deetz. Deetz is the photographer that Berry went off on when he went after Nahla at her school. According to sources, Deetz is more than willing to testify that it is his job to be as aggressive as necessary in order to get the shots he needs.

There will also be expert witnesses who can testify that in France, Berry and Nahla will have a safe haven, since it is a crime to harass celebrities in public. It’s too bad we do not have similar laws in place here in the United States.halle berry in court

There is also expected to be some questions regarding Gabriel’s character. Sources close to Nahla’s father say that the model is aware that Berry’s attorney, Kolodny, will be trying to paint him as a bad father. But Gabriel is worried that if Berry and Nahla succeed in moving overseas, he will grow distant from his daughter.

Why France? The actress’ fiancé Oliver Martinez is from there. The move might not be what the courts will find is in the best interest of Nahla. A recent report that has been put together by some child custody investigators suggests that moving Nahla to Europe would probably not be in the four year old’s best interest. A child psychology expert has also stated concerns about the effect that leaving her father behind in the states could have on Berry’s daughter. The entire move is being left up for the judge to decide.
